Terms of Service

These terms govern your use of websites and apps published by KIH Technologies Ltd ("we", "us"), including FishingTactix, TradeKit and this site (kihtech.co.uk). By creating an account or using our services, you agree to these terms. If you do not agree, please don't use our apps.

1. About us

KIH Technologies Ltd is a company registered in England & Wales (company no. 17214671) at 12 Itchen Close, Bettws, Newport, NP20 7AL. You can reach us at kristan@kihtech.co.uk.

2. Your account

You're responsible for keeping your account credentials safe and for activity that happens under your account. Please tell us promptly if you suspect unauthorised access. You must be at least 13 years old to use our apps. Some features (for example, posting in the FishingTactix community feed) may require you to be 16 or older — those age limits are noted in-app.

3. Acceptable use

Don't use our apps to:

• Break the law, including UK fishing regulations, tax law, financial regulation, or copyright
• Harass, threaten, defame or impersonate anyone
• Upload illegal, infringing or sexually explicit content
• Attempt to break, reverse-engineer, scrape, overload or otherwise interfere with the service
• Misuse community features — for example, posting fake match results in FishingTactix, or fraudulent invoices through TradeKit

We may suspend or terminate accounts that breach these rules. Where appropriate we'll warn you first.

4. Subscriptions and billing

Both FishingTactix and TradeKit offer free tiers and paid subscription plans. Subscription terms — price, renewal date, free trial length — are shown clearly at the point of purchase.

• Auto-renewal: subscriptions renew automatically until cancelled. You can cancel at any time in-app or through your platform (Stripe customer portal, Apple subscriptions, or Google Play subscriptions)
• Refunds: we generally don't issue refunds for partial subscription periods, but UK consumer law gives you a 14-day right of withdrawal where applicable. If something is genuinely wrong, email us and we'll sort it out
• Founder pricing: any "Founder" or "Early Access" pricing is locked at the rate shown when you subscribed, for as long as the subscription remains active and uninterrupted
• Apple / Google subscriptions: if you subscribe through the App Store or Google Play, billing and refunds are handled by Apple or Google under their terms

5. The data you put in

You own the content you create or upload (catch logs, photos, customer records, invoices, etc.). You grant us a limited licence to host, copy and display that content as needed to provide the service — for example, syncing your catches across devices or sending an invoice PDF to a customer. We don't claim ownership and we don't sell your data.

Where you choose to publish content publicly (for example, the FishingTactix community feed), other users will see that content. You can delete public posts at any time.

6. The data we give you

Bite predictions, weather data, regulation summaries, tactical guides and similar content provided by FishingTactix are informational only. Always verify regulations with the relevant authority (Environment Agency, IFI, DAERA, Marine Management Organisation, etc.) and follow safe-fishing practice. We don't accept liability for losses arising from reliance on this information.

TradeKit provides record-keeping tools and direct HMRC submissions. We follow HMRC's specifications carefully but you remain responsible for the accuracy of your tax returns and for meeting your filing obligations. TradeKit is not regulated financial or tax advice — if you're unsure, speak to an accountant.

7. Availability

We aim for high availability but don't guarantee uninterrupted service. We may take the service down for planned maintenance or in response to incidents. Where possible we'll give notice in-app. We're not liable for downtime caused by third parties (your network, ISPs, app stores, payment providers, HMRC infrastructure, etc.).

8. Termination

You may close your account at any time — see our account-deletion instructions. We may suspend or terminate accounts where you breach these terms, where required by law, or where continuing service would be commercially unviable. We'll give you reasonable notice and a chance to export your data where possible.

9. Liability

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded.

Subject to the above, and to the maximum extent allowed by law:

• The apps are provided "as is". We don't warrant they'll be uninterrupted or error-free
• We're not liable for indirect or consequential losses, lost profits, lost data (provided we've followed reasonable care) or lost opportunity
• Our total liability in any 12-month period is capped at the amount you paid us for the relevant subscription in that period (or £100, whichever is higher)

10. Changes to these terms

We may update these terms occasionally. If we make a material change we'll notify you in-app and by email to active accounts at least 14 days before it takes effect. If you don't accept the change you can close your account before it takes effect.

11. Governing law

These terms are governed by the laws of England & Wales. The courts of England & Wales have exclusive jurisdiction over any dispute, except that consumers may have additional rights to bring proceedings in their country of residence under local consumer protection laws.

12. App store specific terms

If you download our apps from the Apple App Store, you also agree to Apple's "Licensed Application End User Licence Agreement" (the standard Apple EULA). Apple is not a party to these terms — it is a third-party beneficiary entitled to enforce the EULA's licence provisions against you.

If you download from the Google Play Store, Google's Play Terms also apply.
